GST Late Fee Waiver - Right or Wrong?

Recent decision of GST Council taken in the 40th council meeting for complete waiver of late fee for nil returns and capping of Rs. 500 pm for othes from July 2017 to Jan 2020 has opened the room for debate over the issue. There are three class of taxpayers with different views on the issue.

 

1. Those who file their returns well before time.

Those who always file their returns in time are not happy with the decision of council. Such class of taxpayers always feel discouraged and demotivated whenever government announces any such waiver shceme. They feel that their timely compliance is not appreciated by government.

2. Those who have filed their returns after due date by paying huge penalty.

Those who filed their returns by paying huge late fees are strongly opposing this decision of council. They are the ones, who have paid penalty out of their hard earned money in govenrment treasury. Such taxpayers demand that they should also get the benefit of waiver and their money should be refunded.

3. Those who have not filed their returns yet.

Those who have not filed their returns till now are quite happy with the decision for obvious reasons.

Right decision, but late decision. Govt already collected unfair late should be refunded or adjusted on tax payable. 40th council meeting decision should be continued for No late fee for Nil return and Rs.500 on tax liability cases.

Late fees waiver July 2017 to Jan 2020 but today as we are going to file GST R-3 B peirod of Dec 2019 for nill filing then late fee to be chargeable here....pls suggest me that waiver fee/no fee ...when it will be applicable w.e.f

Totally wrong decision again regarding late fee and against the natural justice. Now the taxpayers who had filed their returns timely or with penalty and intrest due to some reasons those taxpayers are totally disappointed and many of my clients said to me its clear now we can also do the same thing because this government will again do the same thing in future. So we come to conclusion that this decision is not proper and if they are strict to do so then refund all the penalty intrest along with intrest because when government is taking intrest on any such type of liability then why the taxpayers compromise. I my view the petition should be filed against this step or the alternate prayer to the H'ble Court is that to direct them refund all the penalties or intrest paid by the taxpayers should be refunded

A wrong decision as it will demotivate the honest disciplined taxpayers as well as refund of late fees will be a cumbersome process and a wastage of revenue and time for the authority.

People already paid late fees nearly as.2000 to 5000 so govt not penalising or collecting amount now waiving off.it is very wrong decision.people will not interested to file returns in due dates.

This is Great Dicision By Government. Many tax payers Awaiting this kind waiver late fees Scheem.....Because Now Day Trade Sector Suffering Many Problems. Like Corona..... And economic Problem.......Thank you
