With the consent finally heard. 3. This petition filed under Article 226 of the Constitution takes exception to the order dated 31.08.2024 passed under Section 73 of the Central Goods and Services Tax Act, 2017 (for short, CGST Act”). 4. Learned counsel for the petitioner submits that the adjudicating authority was under a statutory obligation under Section 73 (9) of the CGST Act to determine the tax. However, in Para No. 1 (5), the State Authority opined as under: “Reply: The objections filed by the TP are examined with reference to the documents submitted in this regard ....
