ORDER

The petitioner seeks to assail the order dated 22.11.2019 passed by respondent No.5 contained in Annexure P/1 to the writ petition whereby respondent Nos.4 and 5 rejected the claim for refund of tax filed by the petitioner. 2. The facts of the case in nutshell are that the petitioner’s company which is registered under the provisions of Central Goods and Services Tax Act, 2017 was regularly filing return, however, the petitioner had to bear the burden of the tax. As the petitioner has not passed the incidence of tax to any other person, thus, resultantly the petitioner moved an application for refund of excess tax paid in the State of Madhya Pradesh. However, the revenue issued a deficiency memo dated 14.09.2019 by which the petitioner herein was required to rectify the deficiency within the stipulated period and since the petitioner could not rectify the deficiency, the petitioner’s application for refund dated 23.08.2019 was rejected vide impugned order dated ....
