ORDER This is the first bail application filed by the applicant under Section 438 of the Code of Criminal Procedure, 1973, for grant of anticipatory bail, apprehending his arrest in connection with Crime No. 33/2023, registered at Police Station– Basantpur, District Balrampur (C.G.) for the offence punishable under Sections 420, 467, 468, 471 read with Section 34 of I.P.C. 2. Case of the prosecution, in brief, is that on 16-3-2023, one truck bearing registration No. CG-04-PB-9810 carrying 700 bags of cement was intercepted by the Police Officials and upon inspection of the documents i.e., e-way bill and tax invoice, it was found that as per the documents, the goods were supposed to be delivered to Mahamaya Hardware, Kusmi, however the Truck driver was going to Dhanwar and on the basis of the same, it has been alleged that the accused is trying to evade payment of tax and on the basis of which FIR was lodged and Crime No. 33/2023 has been registered against the applican....
