ORDER HON'BLE PIYUSH AGRAWAL, J. 1. Heard Sri Aditya Pandey learned counsel for the petitioner and Sri Rishi Kumar learned ACSC for the respondents. 2. Since the GST Tribunal has not yet been formed the present writ petition is being entertained against the impugned order passed by the Additional Commissioner (Appeals). 3. Present writ petition has been filed challenging the order dated 19.8.2021 passed by the respondent no.1 in Appeal No. GST-77/20, Assessment Year 2020-21 under the provisions of Section 129(3) of the Uttar Pradesh Goods and Services Tax Act, 2017 (for short 'GST Act”) by which the order dated 21.10.2020 passed by the respondent no.2 has been confirmed. 4. Brief facts of the case are that petitioner was a registered dealer under the GST Act having GSTIN No. 09DHGPK6236N3ZP. (Cancelled on 20.9.2020).
