ORDER 1. Heard Shri Aloke Kumar, learned counsel for the petitioner and Shri Ankur Agrawal, learned Standing Counsel for the respondent. 2. Challenge has been raised to the adjudication order dated 14.12.2023 passed by respondent no.3 under Section 73 of the U.P. GST Act for the period July, 2017 to March, 2018. 3. Submission is, the above order has been passed in gross violation of Sections 75(4) and 75(7) of the Act. Reliance has been placed on orders passed by the coordinate benches of this Court in Writ Tax No.303 of 2024 (Mahaveer Trading Company Vs. Deputy Commissioner State Tax and Another) decided on 04.03.2024, Writ Tax No.168 of 2024 (M/S Shree Salasar Steels Vs. State of U.P. and 2 Others) decided on 16.02.2024 and Writ Tax No.360 of 2024 (M/S Virat Agencies Vs. State of U.P. Through The Principal Secretary) decided on 13.03.2024. 4. Facts being identical, in similar circumstances we have set aside the earlier such adjudication orders. 5. Accordingly, ....
